The focus to resolve the Rule of Law crisis in the EU is often placed on the sanctioning mechanism under Article 7 TEU, the ECJ case law on Article 19 Para. 1 Subpar 2 TEU and, more recently, on the conditionality mechanism to protect the EU budget. However, in this problematic situation the Charter of Fundamental Rights also offers a possible solution that has so far received (too) little attention in the discourse.
This topic will be the basis of the panel discussion on June 23 at 5:30 p.m. After the welcome words by the head of the department, Assoc.-Prof. GDR. Jürgen Pirker (University of Graz; Helmut-Schmidt-University/University of the Federal Armed Forces Hamburg) Univ.-Prof. dr András Jakab (University of Salzburg) and Prof. Dr. Lando Kirchmair (University of the Federal Armed Forces in Munich; University of Salzburg) will present their essay “Anyone who says the rule of law must also mean fundamental rights. Discuss why the EU Charter of Fundamental Rights is the most promising way to enforce the rule of law vis-à-vis member states”. Afterwards, dr. Aistė Mickonytė (University of Graz) will make a short contribution to the influence of the Charter of Fundamental Rights on the concept of a court established by law within the meaning of Union law. Finally, Dr. Stephan Hinghofer-Szalkay (Federal Chancellery Vienna) will review all contributions and moderate the general discussion.
We look forward to welcoming you at our event! To register for this lecture, please contact ksenia.radchenkova(at)uni-graz.at.
